Terms of Service
This document is a working draft for informational purposes and is not legal advice. Have a licensed attorney review it before relying on it.
1. Agreement
These Terms of Service ("Terms") govern your access to and use of BEAM, including the marketing site at https://beamhq.whop.site and any related product, apps, APIs, or services we make available (together, the "Service").
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
If you use the Service through Whop, you also agree to Whop's terms and privacy policy. Where these Terms and Whop's terms conflict on payment or marketplace matters, Whop's terms control for those matters.
2. Operator
The Service is operated by a general partnership of Liam McNiven and Brian Henning, doing business as BEAM ("BEAM," "we," "us," or "our").

3. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.
4. Accounts and credentials
Access to the product may require an account, API key, password, or similar credentials.
You are responsible for:
- Keeping your credentials confidential
- All activity under your account or credentials
- Promptly notifying us if you suspect unauthorized access
We may refuse, suspend, or reclaim credentials that appear compromised, abusive, or obtained without authorization.
5. License
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your personal or internal business purposes.
You may not:
- Copy, modify, or create derivative works of the Service except as we expressly allow
- Reverse engineer, decompile, or attempt to extract source code, except where applicable law forbids this restriction
- Resell, sublicense, or provide the Service to third parties as a hosted offering without our prior written consent
- Remove proprietary notices
All rights not expressly granted are reserved by BEAM and its licensors.
6. Acceptable use
You agree not to use the Service to:
- Violate any law or third-party right
- Probe, scan, or attack systems you do not own or lack permission to test
- Distribute malware, steal credentials, or attempt unauthorized access
- Interfere with or disrupt the Service or other users
- Misrepresent your identity or affiliation
- Scrape or harvest data in a way that burdens or harms the Service
- Use the Service in a way that could cause significant harm to people or critical systems without appropriate authorization and safeguards
We may investigate and suspend or terminate access for violations.
7. Your workspace and content
You retain ownership of content, workspace state, configuration, and materials you submit or store through the Service ("Your Content").
You grant us a limited license to host, process, transmit, and display Your Content solely as needed to operate and improve the Service and as otherwise directed by you.
You represent that you have the rights needed to use Your Content with the Service and that Your Content does not violate law or these Terms.
You are responsible for backing up Your Content. We are not a substitute for your own backups.
8. Security and current product shape
The current BEAM demo provides a persistent Linux desktop you open in a browser. Workspace files and application state live on hosted infrastructure. Access today may use a password-protected demo until Whop membership authentication is enabled.
No system is perfectly secure. We do not warrant that the Service is free from bugs, breaches, or unauthorized access. You remain responsible for:
- Choosing strong credentials and protecting them
- Deciding which machines and browsers you use to connect
- Not treating the marketing site as a guarantee of client-side-only secret storage
Do not rely on BEAM as your only security control for highly sensitive environments.
9. Third parties (Whop and others)
The marketing site is hosted on Whop. Purchases and marketplace features, when offered, may be processed by Whop. Whop acts as payment processor where applicable.
The Service may also rely on infrastructure, hosting, analytics, or other providers. Your use of third-party services is subject to their terms and privacy policies. We are not responsible for third-party services we do not control.
10. Beta and pre-sale status
The Service is early-stage. Paid plans may be offered later via Whop. Features may change, break, or be discontinued without notice.
We may offer free, beta, or preview access. Beta features are provided as-is and may be less stable or less documented than later releases.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, secure, or that data will never be lost or corrupted.
Some jurisdictions do not allow certain disclaimers. In those places, disclaimers apply to the fullest extent allowed.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEAM AND ITS PARTNERS, AFFILIATES, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).
These limits apply even if a remedy fails of its essential purpose. Some jurisdictions limit liability caps; in those places, our liability is limited to the fullest extent allowed.
13. Indemnity
You will defend, indemnify, and hold harmless BEAM and its partners, officers, agents, and contractors from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service
- Your Content
- Your violation of these Terms or applicable law
- Your infringement or misappropriation of third-party rights
14. Termination
You may stop using the Service at any time.
We may suspend or terminate your access immediately if you breach these Terms, if required by law, or if continuing to provide the Service creates risk or harm.
Upon termination, your license ends. Sections that by nature should survive (including ownership, disclaimers, liability limits, indemnity, and governing law) will survive.
We may delete or disable access to Your Content after termination, subject to any legal retention duties and our Privacy Policy.
15. Governing law and venue
These Terms are governed by the laws of the State of Ohio, USA, without regard to conflict-of-law rules.
Exclusive venue for disputes arising out of or relating to these Terms or the Service lies in the state or federal courts located in Ohio, USA, and you consent to personal jurisdiction there, except where applicable law requires otherwise.
16. Changes
We may update these Terms from time to time. We will post the updated Terms on the site and update the effective date. Continued use after changes become effective constitutes acceptance. If you do not agree, stop using the Service.
